RECOMMENDATIONS:
ADOPT Resolution accepting completion of landscape improvements for a Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD21-09588 for a project developed by Loreto Residential, LLC, as recommended by the Public Works Director, Bay Point area. (District V)
FISCAL IMPACT:
No fiscal impact.
BACKGROUND:
The developer has completed the landscape improvements per the Subdivision Agreement (Right-of-Way Landscaping), and in accordance with the Title 9 of the County Ordinance Code.
CONSEQUENCE OF NEGATIVE ACTION:
The completion of improvements will not be accepted as complete, and the warranty period will not begin.

IN THE MATTER OF: Accepting completion of landscape improvements for a Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD21-09588 for a project developed by Loreto Residential, LLC, as recommended by the Public Works Director, Bay Point area. (District V)
WHEREAS, the Public Works Director has notified this Board that the Right-of-Way Landscaping Improvements in subdivision SD21-09588 have been completed as provided in the Subdivision Agreement (Right-of-Way Landscaping) with Loreto Residential, LLC, heretofore approved by this Board.
WHEREAS, these improvements are approximately located near Pullman Avenue and Fairview Avenue.
NOW, THEREFORE, BE IT RESOLVED that the improvements have been COMPLETED as of March 11, 2026, thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement (Right-of-Way Landscaping):

NAME OF SURETY: Lexon Insurance Company
BE IT FURTHER RESOLVED the payment (labor and materials) surety for $19,000.00, Bond No. LICX1215684 issued by the above surety be RETAINED for the six month lien guarantee period until November 19, 2026, at which time the Board AUTHORIZES the release of said surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the Right-of-Way Landscaping improvements, as shown and dedicated for public use on the Final Map of Subdivision SD21-09588, filed June 10, 2025, in Book 559 of final maps at Page 43, Official Records of Contra Costa County, State of California, are ACCEPTED AS COMPLETE
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and the $1,000.00 cash deposit (Auditor's Deposit Permit No. 908779, dated February 25, 2025) made by Loreto Residential, LLC, and the performance/maintenance surety bond $37,000.00, Bond No. LICX1215684 issued by Lexon Insurance Company RETAINED pursuant to the requirements of Section 94 4.406 of the Ordinance Code until release by this Board.
