Report Title:                     APPROVE and AUTHORIZE a License Agreement to Lennar Homes of California, LLC & KL LB BUY 2 LLC in the San Ramon area

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a license agreement between the County and Lennar Homes of California, LLC, (Lennar Homes) and KL LB BUY 2 LLC, (KL Servicers) to license the use of an approximately 641-square-foot portion of the Iron Horse Corridor, between March 3, 2026, and March 2, 2031, for the construction, use, and maintenance of a pedestrian pathway within the licensed area, connecting Lennar’s Iron Horse Village Development project (“Project”) adjacent to the Iron Horse Trail, in exchange for reimbursement of $17,500 for County administrative costs, as recommended by the Public Works Director, San Ramon area, pursuant to Government Code section 25526.5.

 

DETERMINE that the value of the license is less than $25,000 and the use of this area of the Iron Horse Corridor is not necessary for County or other public purposes during the term of the license.

 

CONSIDER the environmental effects of the Project, as shown in the California Environmental Quality Act (“CEQA”) environmental impact report the North Camino San Ramon Specific Plan (the “EIR”) (SCH 2010092014) and the CEQA Addendum to the EIR for the Iron Horse Village Project.

 

ADOPT San Ramon’s findings and statement of overriding considerations in support of the Project.

 

DETERMINE that the portion of the Project that the County is approving by this action will not result in significant environmental effects, and, therefore, there are no alternatives or mitigation measures to substantially lessen those effects; and none of the criteria for subsequent or supplemental CEQA review exist.

 

DIRECT the Public Works Director, or designee, to cause a CEQA notice of determination to be filed with the County Clerk and the State Clearinghouse, pursuant to CEQA Guidelines section 15096(i).

 

DIRECT the Real Estate Division of the Public Works Department to cause said License Agreement to be delivered to the grantee.

 

FISCAL IMPACT:

Grantee will reimburse the County in the amount of $17,500 in County staff time to complete this transaction.

 

BACKGROUND:

The Real Estate Division respectfully recommends that the Board approve the execution of the License Agreement with Lennar Homes and KL Servicers. The area being licensed to Lennar Homes and KL Servicers consists of approximately 641-square-feet of land within the County’s Iron Horse Corridor and will provide ingress and egress access between the Iron Horse Trail and Lennar Homes’ Iron Horse Village Development via an asphalt pedestrian pathway in the licensed area. The license agreement has a 5-year term. In accordance with the City of San Ramon’s Conditions of Approval for Lennar’s new residential development, the proposed access path must receive approval from the County prior to the issuance of a Site Development Permit.

 

The City of San Ramon is the CEQA lead agency for the Project. The City of San Ramon certified the environmental impact report for the North Camino Ramon Specific Plan (State Clearinghouse 2010092014) and the CEQA Addendum to the EIR for the Project.

The County is a responsible agency under CEQA (see CEQA Guidelines, § 15096). Public Works Department staff have reviewed the EIR for the Project. The portions of the Project the County is responsible for do not result in any significant environmental impacts because they consist of conveying a license covering a relatively small pedestrian pathway measuring approximately 641-square-feet in area. None of the criteria for subsequent or supplemental environmental review have been triggered. Therefore, staff recommends that the Board takes the recommended actions outlined in this staff report.

 

CONSEQUENCE OF NEGATIVE ACTION:

If this License Agreement is not approved, the County would not grant the use of this portion of its property to the Grantee.
