Report Title: Temporary Entry Permit between County and West County Wastewater District for the Maintenance Division’s use of the property, APN 403-020-011
Recommendation: Recommended by the County Administrator
RECOMMENDATIONS:
APPROVE and AUTHORIZE the Maintenance Division, or designee, to execute a Temporary Entry Permit with West County Wastewater District to use the property, APN 403-020-011, as an access route to perform maintenance work on the Lettia Road storm drain outfall area during the period from August 3, 2026, through October 1, 2026 (WO2320).
FISCAL IMPACT:
No fiscal impact. There is no cost associated with this Permit.
BACKGROUND:
The Maintenance Division is seeking authority to execute a Temporary Entry Permit (Permit) with the District for access through District property commonly known as the Tara Hills Lift Station (APN 403-020-011) to perform maintenance work on the Lettia Road storm drain outfall area. The Permit term has been set to start this summer and end in the fall. The Permit allows the County to utilize an agreed-upon access route through the District’s property so that staff can access the drainage site.
The purpose of this project is to remove accumulated sediment from the outfall area of a 54-inch storm drain to facilitate the conveyance of stormwater flows from the Montalvin Manor subdivision. The Maintenance Division will clear vegetation obstructing the access route and work area, install a coffer dam system to dewater the project area, use an articulated spider/walking excavator to remove approximately 10-20 cubic yards of accumulated sediment from the outfall area that consists of a pool approximately 30 feet in diameter and 3-feet deep, rewater the system, and haul off slit.
The Permit requires the County to indemnify the District and its respective employees, agents, officers, managers and members from and against all claims, demands, liabilities, damages, costs and expenses arising from the County’s use of the property.
CONSEQUENCE OF NEGATIVE ACTION:
The Maintenance Division will not be able to enter into an agreement for use of District property as an access route.
