RECOMMENDATIONS:

 

APPROVE and AUTHORIZE the Office of Communications & Media Director, or designee, to execute service level agreements with cities within Contra Costa County that are or may be interested in having access to public, educational and governmental channels from Contra Costa Television (CCTV) to produce, cablecast, and otherwise broadcast programming.

 

FISCAL IMPACT:

 

The Division’s cost to provide cable channel management and production services to each contracted jurisdiction is funded by 100% cable franchise fees, PEG funds, and contract city revenue. 

 

BACKGROUND:

 

Since 1986, CCTV has provided services to client cities for cable channel management and production services. For decades, CCTV has charged a $68/hour rate for services. This rate was based on estimated Division costs. Historically, the County has subsidized a significant portion of the contracted cities’ cost for CCTV services.

 

Individually, the cities collect cable franchise fees and Public, Education, and Government (PEG) funds, which are used to invest in infrastructure to provide cable access and content to residents.

 

In May 2023, CCTV met with client cities to discuss a proposed rate increase, which reflects the actual cost to CCTV for providing the services to cities. In addition, CCTV proposed a formal service level agreement to cities for review and comment.

 

In September 2023, CCTV met with the County Administrator’s Office to discuss a gradual rate increase. Rates were developed in consultation with the Budget division and reviewed by staff of the contract cities.

In May 2024, CCTV followed up with the client cities as discussed to gather feedback on the agreement and the proposed rates. Since that time, CCTV has received comments to the service level agreement from several of the Cities and integrated those comments into the final service level agreement. A current list of client Cities is outlined below:

                     Martinez

                     Hercules

                     San Ramon

                     Clayton

                     Pleasant Hill

                     Pittsburg

                     Antioch

                     Moraga

 

The agreements with the cities would be one-year agreements that can be renewed for three successive years, and contain a mutual indemnification clause. Pursuant to the agreements, CCTV will access to available public, educational and governmental channels to produce, cablecast, and otherwise broadcast programming.

 

Today’s action requests authorization from the Board of Supervisors to execute service level agreements with each of the client cities above and any other cities in the future that may be interested in receiving services from CCTV using this standard agreement.

 

CONSEQUENCE OF NEGATIVE ACTION:

 

If this action is not approved, the County will continue to subsidize CCTV services for client cities at the current rate of $68/hr.
