RECOMMENDATIONS:

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Data Use Agreement (DUA) #72-245 with Kaiser Foundation Health Plan, Inc., a non-profit corporation, to provide data to County as instructed by Department of Health Care Services (DHCS) to support the County’s Population Needs Assessment (PNA) to identify priority needs of their local community and identify health disparities for the period December 1, 2024 through November 30, 2028.

 

FISCAL IMPACT:

This is a non-financial Agreement.

 

BACKGROUND:

In December 2023, The California Department of Public Health (CDPH) sent a notice to Local Health Jurisdictions from the Office of Policy and Planning Regional Public Health Office, regarding Alignment of Medi-Cal Managed Health Care Population (MCPs) Needs Assessment and Local Health Jurisdiction Community Health Assessments (CHAs) and Community Health Improvement Plans (CHIPs) providing guidance to shift CHA’s and CHIPs to a statewide synchronized three-year reporting cycle with the requirement to prepare and provide a completed submittal of these reports to CDPH due in  December, 2028 and June 2029 respectively.

 

Contractor has been instructed by CDPH to provide certain data to County, for the purpose of supporting the County’s PNA to identify priority needs of their local community and identify health disparities. Contractor will provide required information to County through a DUA which will enable Contractor’s information to be included in these CDPH reporting requirements. Recently, as part of the California Advancing Innovation in Medi-Cal (CalAIM) Population Health Management Initiative, all MCPs are required to engage in local health department CHA/CHIP processes to fulfill their PNA requirement.

 

Approval of this new Data Use Agreement #72-245 will allow Contractor to provide data use support to fulfill the CDPH requirements for CHA and CHIPs reporting processes through November 30, 2028. This Agreement includes agreeing to indemnify, hold harmless and defend the Contractor, Kaiser Foundation Hospital and the Permanente Medical Group for claims arising out of County’s performance or failure to perform under this Contract.

 

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, CHPH PNA report will not include Contractor’s data which will result in non-compliance with CDHP regulation requirements.
