RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Standard Agreement #29-533-8 (State #25-50126) with the California Department of Health Care Services, to provide Managed Mental Health Care services for Medi-Cal eligible residents of Contra Costa County for the period from July 1, 2025 through December 31, 2026.
FISCAL IMPACT:
There is no fiscal impact. The County will be paid for services in accordance with Chapter 3, Part 2, Division 5 of the Welfare and Institutions Code along with Sections 5600, 5750, 5650 and Government Code Sections 11138, 14705, and 14718.
BACKGROUND:
The goal of Managed Mental Health Care is to provide covered specialty mental health services, including medication support, day treatment intensive, day rehabilitation, crisis intervention, crisis stabilization, adult residential treatment, crisis residential, psychiatric health facility and targeted case management services. Covered mental health services include psychiatric inpatient treatment and early periodic screening, diagnosis and treatment (EPSDT) supplemental specialty mental health services. The County has been contracting with the State for these services since April 1, 2012.
On November 1, 2022, the Board of Supervisors approved Standard Agreement #29-533-6 with the California Department of Health Care Services, for the provision of Managed Mental Health Care for Medi-Cal eligible residents of Contra Costa County through June 30, 2027, which included agreeing to indemnify and hold the State harmless for claims arising out of the County’s performance under the Agreement.
On June 4, 2024, the Board of Supervisors approved Amendment Agreement #29-533-7 with the California Department of Health Care Services, to update terms and conditions for the continuation of mental health services to Medi-Cal eligible residents with no change in the term of July 1, 2022 through June 30, 2027.
Approval of Agreement #29-533-8 will allow County to provide Managed Mental Health Care services for the 2025/2026 fiscal year. This Agreement includes the State’s updated terms and conditions for specialty mental health care services. This Agreement includes an indemnity provision which requires the County to defend, indemnify and hold the State harmless from any claims arising out of the County’s performance under the Agreement. The Agreement is delayed due to County receiving the Agreement from DHCS on July 25, 2025.
CONSEQUENCE OF NEGATIVE ACTION:
If this Agreement is not approved, the County will not be able to continue providing Managed Mental Health Care services to Medi-Cal eligible residents of Contra Costa County and will be out of compliance with the State.
