RECOMMENDATIONS:
As the governing body of the Contra Costa County Flood Control and Water Conservation District (District), the Board of Supervisors is requested to:
DETERMINE that the interest in land conveyed under the License Agreement is in the public interest and will not substantially conflict with or interfere with the use of the property by the District.
APPROVE and AUTHORIZE the License Agreement with Good Sports, LLC, a California limited liability company ("Licensee"), for the use and maintenance of approximately 3,800 square feet of District property (APN 188-077-018), with the term beginning October 7, 2025, through October 7, 2035.
AUTHORIZE the Chief Engineer, or designee, to execute the License Agreement with Good Sports, LLC, on behalf of the District.
DETERMINE that this activity is not subject to the California Environmental Quality Act (CEQA), pursuant to Article 5, Section 15061(b)(3) of the CEQA Guidelines as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.
FISCAL IMPACT:
The license agreement will obligate Good Sports, LLC to pay an annual fee of $4,500 for the first year, with an increase of three percent (3%) every two years. Payment shall be hand delivered or mailed to the Contra Costa County Flood Control & Water Conservation District, Public Works Department, Attention: Real Estate Division, 255 Glacier Drive, Martinez, California 94553.
BACKGROUND:
The Contra Costa County Flood Control and Water Conservation District (District) owns land that includes Grayson Creek in Pacheco, California, situated west of Good Sports, LLC’s property at 5844 Pacheco Boulevard. The proposed agreement grants Good Sports, LLC a nonexclusive license to use approximately 3,800 square feet of the District’s property, APN 188-077-018, for ingress and egress of refuse collection trucks and trucks delivering goods to their tenants. The District is willing to grant the license under the condition that Good Sports, LLC is responsible for maintaining the pavement and signage on the District’s property.
CONSEQUENCE OF NEGATIVE ACTION:
If the Board of Supervisors does not approve this agreement, Good Sports LLC will be unable to use the District’s property for access purposes, which could disrupt their operations. The District could be held liable for Good Sports LLC unauthorized use of District property and will also lose the revenue from the annual license fee.
