RECOMMENDATIONS:

 

APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Employment and Human Services Department, a purchase order and related agreement with Rackspace US, Inc., subject to the terms of Rackspace’s Master Service Agreement, for the purchase of Rackspace-Server Upgrade and Armor Platform, in the amount not exceed $39,350 for the period May 1, 2024 through April 30, 2027.

 

FISCAL IMPACT:

 

$39,349.52: 59% Federal, 35% State, 6% County General Fund, all of which is budgeted in FY24/25

 

BACKGROUND:

 

The Employment and Human Services Department (EHSD) selected Rackspace-Server Upgrade and Armor Platform because it is compatible with EHSD existing website software, WordPress, it provides more advanced features, such as the ability to connect to internal systems and run non-WordPress-based web software, and it allows connection to internal databases securely.  The current servers and Operating System (OS) supporting EHSD.ORG will reach an end of life in June 2024 and no longer be supported.  Rackspace will update the entire site including migration of data to a new hosted environment while maintaining data security and regulatory compliance.  Their comprehensive security protocols, including threat detection, intrusion prevention, and data encryption, assure that EHSD sensitive information always remains protected. 

 

This purchase order includes a service agreement that includes an indemnification clause from the County to Rackspace, as well as capping Rackspace’s liability to the greater of six times the fees payable for the services that are subject of the claim or the total amount paid in the prior twelve (12) months, which has been approved by County Counsel. This vendor was selected per procurement requirements outlined in Administrative Bulletin 600.3.

 

CHILDREN'S IMPACT STATEMENT:

 

This agreement supports all five of the community outcomes established in the Children's Report Card: (1) "Children Ready for and Succeeding in School"; (2) "Children and Youth Healthy and Preparing for Productive Adulthood";(3)"Families that are Economically Self-Sufficient"; (4) "Families that are Safe, Stable and Nurturing"; and (5) "Communities that are Safe and Provide a High Quality of Life for Children and Families,” by supporting staff working directly with families and children

 

CONSEQUENCE OF NEGATIVE ACTION:

 

The County will be limited in maintaining data security and regulatory compliance when updating the entire EHSD.org website including migration of data to a new hosted environment; thus, will be limited in generating engaging and effective content for the public.
