RECOMMENDATIONS:

APPROVE and AUTHORIZE the Director of Human Resources, or designee, to execute a contract with GovernmentJobs.com, Inc. (dba NeoGov), in an amount not to exceed $626,521 for a vendor-hosted internet-based performance management system for the period of October 15, 2025, through October 14, 2028.

 

FISCAL IMPACT:

The $220,295.00 cost for the first year of service is within the Human Resources Department FY 25-26 budget, and remaining contract costs will be budgeted in subsequent years. 100% General Fund.

 

BACKGROUND:

The County conducted a Request for Proposals (RFP) to solicit vendors for a countywide performance management system. The bid was awarded to GovernmentJobs.com, Inc. (dba NeoGov). The performance management system will enable supervisors to review, evaluate, and document employee performance in a consistent and equitable manner across all participating departments. By standardizing the employee review process, the County can provide meaningful and measurable data to employees and supervisors for the tenure of employment.

 

The contract being executed is governed by the Service Agreement, dated January 10, 2025, between GovernementJobs.com, Inc., and the County. The performance management system will be hosted on the internet by the vendor. The agreement obligates the County to indemnify the vendor for third-party losses arising out of the infringement or misappropriation of such third-party’s intellectual property rights, in connection with the County’s violation of any applicable laws, and against any third-party claim or allegation resulting from the County’s breach of the agreement. The agreement obligates the vendor to indemnify the County for third-party losses arising out of the infringement or misappropriation of such third-party’s intellectual property rights, provided that the vendor’s indemnity obligation shall not exceed the amount of all payments actually received by GovernmentJobs.com, Inc. (dba NeoGov) from the County in connection with the Service Agreement in the 12-month period preceding the date of the first event initially giving rise to such liability.

 

CONSEQUENCE OF NEGATIVE ACTION:

If the contract is not approved, we will not be able to access the vendor’s performance management system, which would significantly hinder the ability to measure employee growth and success in a consistent and equitable manner.
