RECOMMENDATIONS:

 

APPROVE and AUTHORIZE the Auditor-Controller, or designee, to pay $300,000 to Delta Personnel Services, Inc. dba Guardian Security Agency, a corporation, for provided security services for Contra Costa Regional Medical Center (CCRMC) and Health Services Clinics, for the period June 1, 2024 through October 29, 2025.

 

FISCAL IMPACT:

 

Approval of this payment will result in a one-time expenditure of up to $300,000 and will be funded 100% by Hospital Enterprise Fund I.

 

BACKGROUND:

 

Delta Personnel Services, Inc. dba Guardian Security Agency, provides security services for Contra Costa Regional Medical Center (CCRMC) and Health Services Clinics. These services include on-site security coverage to ensure the safety of staff, patients, and visitors, as well as visitor entrance screening at CCRMC.

 

On April 28, 2025, the Board of Supervisors approved Contract Amendment Agreement #26-352-22 with Delta Personnel Services, Inc. dba Guardian Security Agency, to amend Contract #26-352-17 (as amended by #26-352-18 and #26-352-19), to increase the payment by $400,000, from $6,461,750 to a new payment limit of $6,861,750, for additional security guard services at the Contra Costa Youth Stabilization Unit and Behavioral Health Oak Grove facilities, with no change in the original term of January 1, 2023 through December 31, 2025.

 

On October 9, 2025, in accordance with Health Services procurement regulations, CCRMC issued a competitive contract bid for security services to all local vendors, including Guardian Security Agency. The Request for Proposal (RFP) evaluation process began on October 29, 2025. Due to the unusually high volume of vendor responses, the RFP review process was delayed. As a result, Guadian Security Agency’s contract expired on December 31, 2025, while the RFP process remained ongoing.

 

Also, due to the service addition of 25 Allen Street, Suite B, and the CCRMC Psych Unit security and transportation duties, a request for additional funding could not be submitted and approved prior to the contract expiration date. Therefore, retroactive payment is required to cover invoices for security services rendered from June 1, 2024 through October 29, 2025.

 

The Contractor is entitled to payment for the reasonable value of its services under the equitable relief theory of quantum meruit.  That theory provides that where a contractor has been asked to provide services without a valid contract, and the contractor does so to the benefit of the County, the Contractor is entitled to recover the reasonable value of those services. The Contractor has provided services at the request of the County after the original contract payment limit had been reached. The Department cannot pay Contractor for services rendered that exceed the contract limits. As such, the Department recommends that the Board authorize the Auditor-Controller to issue a one-time payment not to exceed $300,000 to Delta Personnel Services, Inc. dba Guardian Security Agency.

 

CONSEQUENCE OF NEGATIVE ACTION:

 

If this payment is not approved, the Contractor will not be paid for services requested by County staff and provided by Contractor in good faith.
