Report Title:                     Contract Amendment for the 2024 On-Call Fencing Services Contract for Various Road, Flood Control, and Facilities Maintenance Work, Countywide.

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Hennessey’s Construction and Fence, to increase the payment limit by $500,000 to a new payment limit of $1,900,000 and extend the term through August 5, 2027 to continue providing additional fencing services, Countywide.

 

FISCAL IMPACT:

100% Local Road, Flood Control, and General Fund.

 

BACKGROUND:

On August 6, 2024, the County awarded an on-call fencing contract for various road, flood control, and facilities maintenance road work to supplement Public Works road maintenance and Facilities maintenance crews during routine and emergency work, and to perform time sensitive work requiring specialized equipment and skills.  A $400,000 contract was awarded to Hennessey’s Construction and Fence (Hennessey).

 

On April 28, 2025, the Board of Supervisors approved Contract Amendment No. 1 for Hennessey, extending the contract terms from August 5, 2025 through August 5, 2026 and increasing the payment limit from $400,000 to $1,400,000.

 

This contract is utilized by both the Road Maintenance Division and the Facilities Division, and both have fully exhausted Hennessey’s current capacity. Efforts to engage alternate vendors, Alta Fence Co. and Crusader Fence Company, LLC, have been unsuccessful due to lack of responsiveness or scheduling conflicts that do not meet our project timelines. Hennessey, however, has remained available and responsive to our needs.  To ensure adequate contract capacity for upcoming fence work for both divisions, an amendment is necessary to extend the contract term and increase the contract payment limit.

 

To retain the services of, and to ensure timely payment to Hennessey, the Public Works Director recommends that the Board approve Contract Amendment No. 2. This amendment will increase the payment limit of the contract with Hennessey to a new payment limit of $1,900,000 and extend the term through August 5, 2027.

 

 

 

 

CONSEQUENCE OF NEGATIVE ACTION:

Failure to approve the contract amendment will prevent the Public Works Department from completing routine and emergency road, flood control, and facilities maintenance work in a timely manner.
