RECOMMENDATIONS:

ADOPT Resolution ratifying the prior decision of the Public Works Director, or designee, to fully close a portion of McAvoy Road, on May 15, 2026, through May 16, 2026, from 9:00 p.m. through 3:00 a.m., for the purpose of emergency railroad track repairs, Bay Point area. (District V)

 

FISCAL IMPACT:

No fiscal impact.

 

BACKGROUND:

BNSF discovered a track defect on their crossing at McAvoy Road and requested this full road closure to allow them to make repairs. BNSF, through their traffic control contractor, requested an overnight closure of McAvoy Road in order to minimize disruption for local residents and businesses.

 

A county-maintained road may be closed with approval of the Board of Supervisors and a road closure permit.  Applicant must adhere to the permit conditions set forth by the Public Works Director, or designee, prior to and during the road closure. 

 

CONSEQUENCE OF NEGATIVE ACTION:

BNSF will not have Board approval for completed road closure.

IN THE MATTER OF: Ratifying the prior decision of the Public Works Director, or designee, to fully close a portion of McAvoy Road, on May 15, 2026, through May 16, 2026, from 9:00 p.m. through 3:00 a.m., for the purpose of emergency railroad track repairs, Bay Point area. (District V)

NOW, THEREFORE, BE IT RESOLVED that permission is granted to Superior Barricades LLC (for BNSF) to  fully close a portion of McAvoy Road from before the BNSF rail crossing to the end of the public street, except for emergency traffic, on May 15, 2026, through May 16, 2026, from 9:00 p.m. through 3:00 a.m., subject to the following conditions:

 

1. All signing to be in accordance with the California Manual on Uniform Traffic Control Devices.

 

2. Superior Barricades LLC and BNSF Railway Company shall comply with the requirements of the Ordinance Code of Contra Costa County.

 

3. Provide the County with a Certificate of Insurance in the amount of $1,000,000.00 for Comprehensive General Public Liability which names the County as an additional insured prior to permit issuance.

 

4. Obtain approval for the closure from the Sheriff’s Office, the California Highway Patrol and the Fire District.
