Report Title: County Sponsored Environmental Health Home-Based Restaurant and Mobile Food Cart Workshops and Agreements

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Health Services Director, or designee, to execute four rental agreements with the (1) Ambrose Recreation and Parks District, (2) Lafayette Library and Learning Center Foundation, (3) City of Oakley, and (4) City of Richmond in an amount not to exceed $10,000 for the combined total in rental fees and facility use for the purpose of conducting public workshops through December 31, 2024.
FISCAL IMPACT:
The fiscal impact of this action will not exceed $10,000 and is funded by Environmental Health.
BACKGROUND:
Environmental Health is conducting workshops for persons interested in opening a home-based restaurant (microenterprise home kitchen operation) and/or food cart (compact mobile food operation) in Contra Costa County. The workshops, which are free and open to the public, are intended to assist prospective food business owners in understanding the requirements and navigating the process of obtaining a health permit.
Workshops for 2024 will be conducted at the following locations:
- Ambrose Community Center in Bay Point
- Arts & Science Discover Center in Lafayette
- Oakley Recreation Center in Oakley
- Shields-Reid Community Center in Richmond
The Ambrose Recreation and Park District facility use permit application obligates Contra Costa County to agree to indemnify, defend, and hold harmless the park district. It also contains a provision waiving and releasing liability and the contract between Contra Costa County and Ambrose Recreation and Park District.
The Lafayette Arts & Science Discovery Center Rental Agreement requires that Contra Costa County is solely responsible for any and all accidents or injuries to persons or property arising from use of facilities.
The Oakley Recreation Center rental application requires Contra Costa County to reimburse the City of Oakley for all damages and holds the City of Oakley harmless from any damage, liability, cost, or legal expense that may arise from the county’s use of the facility.
The City of Richmond facility rental agreement & park use permit obligates Contra Costa County to indemnify, save, and hold harmless the City of Richmond from any and all liability arising during the term of the rental agreement and the City will have no liability for loss or damage to Contra Costa County’s goods, property, or equipment.
CONSEQUENCE OF NEGATIVE ACTION:
If this action is not approved, prospective food business owners will be less informed of their options to legally enter the food economy, and food safety concerns may arise.
