Report Title:                     Amendment to Real Property Services Agreement between County and Contra Costa Transportation Authority

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute, on behalf of the County, Amendment No. 1 to a Real Property Services Agreement with Contra Costa Transportation Authority (CCTA), effective June 9, 2026, to increase the County’s maximum compensation by $350,000, for a new total of $670,000, for I680/SR4 Interchange Project Phases 1, 2A, and 4 right-of-way acquisition, as recommended by the Public Works Director, Martinez/Pacheco Area. Project No. 4660-6X4175/Federal Project No. 04200001561.

 

FISCAL IMPACT:

100% Contra Costa Transportation Authority Funds. CCTA will pay the actual costs of compensation and right way services performed by the Real Estate Division, up to the new payment limit.

 

BACKGROUND:

CCTA requires a variety of right-of-way services related to the I-680/SR4 Interchange Project Phases 1, 2A and 4, but has no right-of-way staff. CCTA has contracted with the County for these services. The County’s services include right-of-way acquisition, appraisal valuation, relocation, condemnation (as needed and if approved by the Board of Supervisors), demolition, property maintenance, and file close out for the project. 

 

On April 9, 2024, the Board approved the original agreement between the County and CCTA.  Additional funds from CCTA are required for the County to provide the necessary compensation to property owners. Accordingly, this amendment increases the total agreement value by $350,000, for a total agreement value of $670,000, to reflect a $320,000 increase in the budgeted amount for negotiations and acquisitions.

 

CONSEQUENCE OF NEGATIVE ACTION:

The County will not be able to meet the obligations of Right of Way Contracts as part of the acquisition process.
