Report Title:                     Center for Infectious Diseases General Data Use and Disclosure Agreement #72-295 with California Department of Public Health

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a Data Use and Disclosure Agreement (DUA) #72-295 with California Department of Public Health (CDPH), a public agency, governing the Public Health Division’s collection, receipt, use and disclosure of Center for Infectious Diseases data, for a period of three years from the execution date of the Agreement.

 

FISCAL IMPACT:

This is a non-financial agreement. There is no cost to the County.

 

BACKGROUND:

The Center for Infectious Diseases (CID) is a program of the CDPH, which coordinates public health surveillance and epidemiological studies to define, prevent and control infectious diseases and to assist local health jurisdictions plan, develop, implement, and improve prevention, control, care, treatment, and social support programs for infectious diseases. Local health departments collect, use, and share critical infectious disease data through multiple database platforms, including CAIR (California Immunization Registry), CalREDIE (California Reportable Disease Information Exchange), I2D2 (Integrated Infectious Disease Data Warehouse), the My Turn Vaccine Management System and CalCONNECT, the online database that maintains information, originally collected by CDPH and local health departments throughout California, related to Contagious or Reportable Diseases and Conditions.

 

The DUA provides the terms, conditions and limitations of the Public Health Division’s collection, receipt, use and disclosure to ensure the secure exchange of this critical public health data among California’s local health departments and CID. The DUA defines the specific data elements that may be shared, the technical and administrative safeguards required to protect personal and confidential information, the roles and responsibilities of each participating entity, and the permitted uses and limitations governing the data. These provisions ensure that all data sharing activities comply with State and Federal privacy laws, support consistent public health reporting practices, and maintain the integrity and security of sensitive information.

 

The data collected in the CDPH databases is collected for the mutual benefit of the counties and the state under the authority of Health & Safety Code section 120130 et seq. and 17 California Code of Regulations section 2500 et seq. Local health offices must execute this DUA before they will be permitted to collect, receive, use or disclose the data from the above-described infectious disease databases and they and CDPH agree, through execution of this DUA to mutually indemnify, hold harmless and defend  DUA participants  for claims that result from or arise out of or in connection with an act, omission or the willful misconduct of the participant or of CDPH.

 

Approval of DUA #72-295 will allow the Contractor to govern the Public Health Division’s collection, receipt, use and disclosure of Center for Infectious Diseases data for a period of three years from the execution of the agreement.

 

CONSEQUENCE OF NEGATIVE ACTION:

If the execution of the DUA is not authorized and approved, Contra Costa Health Services will not be permitted to access and participate in the CID databases and will be out of compliance with state mandated data sharing requirements.
