Report Title:                     Resolution Approving Side Letters Providing for MOU Extensions, Wages, and One-Time Lump Sum Payment.

RECOMMENDATIONS:

ADOPT Resolution No. 2026-276 approving the Side Letters between the County of Contra Costa and AFSCME Local 512, AFSCME Local 2700, AFSCME Local One, IFPTE Local 21, SEIU Local 1021, the Deputy District Attorneys Association, the Contra Costa Defenders Association, the District Attorney Investigators Association, and the Western Council of Engineers, providing for MOU extensions, salary increases, and a one-time lump sum payment.

 

 

FISCAL IMPACT:

The estimated annual cumulative cost for the negotiated salary increases extensions is $20.6 million for FY 2026/27. The lump sum payment is expected to have a one-time cost of approximately $5.4 million dollars.

 

Operating departments will be responsible for absorbing the increased personnel costs and will need to monitor expenditures to remain within budget during the fiscal year.

 

BACKGROUND:

The Side Letters arise out of a formal request to bargain from the Union Coalition, comprised of AFSCME Local 512, AFSCME Local 2700, AFSCME Local One, IFPTE Local 21, SEIU Local 1021, the Deputy District Attorneys Association, the Contra Costa Defenders Association, and the Western Council of Engineers. These employee organizations have contracts expiring on June 30, 2026. The County and Union Coalition agreed to negotiate a one-year extension on the limited subject of salary. Following the tentative agreement with the above unions on May 21, 2026, the District Attorney Investigators Association requested to bargain a similar agreement and the parties reached a tentative agreement on June 2, 2026.

 

The nine unions immediately began the process of conducting ratification votes, and each tentative agreement has been ratified by their respective memberships as of the date of this action.

 

In summary, the County and unions agreed to an MOU extension to modify the following provisions in the existing MOUs:

 

1.                     Duration of Agreement

a.                     The term of the agreements were extended through June 30, 2027.

2.                     Wages

a.                     Effective July 1, 2026, the base rate of pay for classifications represented by the Unions will be increased by three percent (3%).

3.                     One-Time Lump Sum

a.                     Full-time Permanent and Project employees in positions represented by the Union and who are employed by the County on July 1, 2026, will receive a one-time lump sum payment in the amount of one thousand dollars ($1,000) on the August 10, 2026, pay warrant. Part-time Permanent and Project employees who are employed by the County on July 1, 2026, will receive the amount prorated based on the employee’s regular position hours. The lump sum will be subject to any required deductions and/or withholdings.

b.                     Temporary employees represented by the Union who are employed by the County on July 1, 2026, will receive a one-time lump sum payment in the amount of five hundred dollars ($500) on the August 10, 2026, pay warrant, subject to the following conditions:

i.                     The temporary employee worked at least eighty (80) hours between May 1, 2026, and May 31, 2026, and

ii.                     The lump sum will be subject to any required deductions and/or withholdings.

iii.                     Per Diem and Retiree Temporary employees are not eligible for the lump sum payment.

 

 

CONSEQUENCE OF NEGATIVE ACTION:

 

Represented employees will not receive wages agreed to in the tentative agreements between the Unions and County.

The Contra Costa County Board of Supervisors acting in its capacity as the governing body of Contra Costa County and the Board of Directors of the Contra Costa County Fire Protection District RESOLVES THAT:

 

The attached Side Letters of Agreement between the County of Contra Costa and AFSCME Local 512, AFSCME Local 2700, AFSCME Local One, IFPTE Local 21, SEIU Local 1021, the Deputy District Attorneys Association, the Contra Costa Defenders Association, the District Attorney Investigators Association, and the Western Council of Engineers be ADOPTED.
