Report Title: Purchase of Four Acres of Undeveloped Property in Brentwood for $2,040,000.

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Public Works Director to execute a Purchase and Sale Agreement between the County and Mission Peak Homes, Inc. for the County’s purchase of approximately four acres of undeveloped Real Property located at 2305 and 2313 Windy Springs Lane in Brentwood (Property), at a purchase price of $2,040,000 (Purchase Price), for future public purposes, including the possible construction of a community center and a fire station.
DETERMINE the purchase of the Property is not subject to the California Environmental Quality Act (CEQA), pursuant to Article 5, Section 15061 [b][3] of the CEQA Guidelines because it can be seen with certainty that there is no possibility this activity may have a significant impact on the environment.
DIRECT the Director of Conservation and Development (DCD), or designee, to file a Notice of Exemption (NOE) with the County Clerk and the State Clearinghouse.
AUTHORIZE the Public Works Director, or designee, to arrange for payment of a $25 fee to DCD for processing, and a $50 fee to the County Clerk for filing the NOE.
ACCEPT the grant deed from Mission Peak Homes, Inc. for the purchase of the Property.
AUTHORIZE the Auditor-Controller to wire approximately $2,047,577.36, payable to Comerica Bank, 2321 Rosecrans Avenue, Suite 5000, El Segundo, CA 90245, Routing No. 121137522, Account No. 1891527879, for credit to Old Republic Title Company, 200 Sand Creek Road, Suite A, Brentwood, CA 94513, Escrow Number 0120036934, Attn: Faris Sanchez-Tischler, Escrow Officer, (925) 634-1010, which amount is equal to the Purchase Price and estimated closing costs.
DIRECT the Real Estate Division to have this Staff Report delivered to Old Republic Title Company, for Escrow No. 0120036934, for recording in the office of the County Recorder.
FISCAL IMPACT:
The purchase price and closing costs will be paid using Measure X funds.
BACKGROUND:
The Property is undeveloped land that is adjacent to Lone Tree Way, a major thoroughfare in Brentwood, and close to both residential and commercial properties. These features, combined with the scarcity of undeveloped property in this portion of East County, make this site a good location for a number of potential public projects. One potential project that is under consideration is the development of a community center. Another potential project is the construction of a fire station. Additional planning and design would be required before the County could complete meaningful CEQA review of any possible future use.
Specific development projects, and related analysis of those projects under CEQA, will be the subject of future Staff Reports.
A notice of this Board’s intention to consider this property acquisition at today’s meeting was duly published in the Contra Costa Times in compliance with Government Code Sections 25350 and 6063.
CONSEQUENCE OF NEGATIVE ACTION:
The County will not purchase the property.
