RECEIVE public report of litigation settlement agreements that became final during the period October 1, 2024, through October 31, 2024.

BACKGROUND:

Two agreements to settle pending litigation, as defined in Government Code section 54956.9, became final during the period October 1, 2024, through October 31, 2024.

TCH - Orange County, LLC d/b/a Kindred Hospital - San Francisco Bay Area v. Contra Costa Health Services d/b/a Contra Costa Health Plan; Alameda County Superior Court, Case Nos. 23CV03270 and 24CV071972. On September 24, 2024, the Board of Supervisors approved a settlement in this breach of contract case involving MediCal billing rates. The Board approved the settlement for $750,000 in closed session by a vote of 5-0. The settlement agreement was fully executed on October 9, 2024. The funding source is the Health Services Department.

Contra Costa County Fire Protection District v. The Heirs and Devisees of P.J. Moody, et al.; Contra Costa County Superior Court, Case No. C24-00316. On September 10, 2024, the Board of Supervisors approved a settlement in this eminent domain action. The District filed this action to condemn fee title to a 2,250 square foot strip of land needed for the construction of new Fire Station No. 94, in downtown Brentwood. The settlement requires the District to pay defendants $65,000 for the property being acquired. The Board approved the settlement in closed session by a vote of 5-0. A stipulated judgment in condemnation was entered on October 7, 2024. The settlement will be paid from Fire Protection District funds.
