RECEIVE public report of litigation settlement agreements that became final during the period May 1, 2026, through May 31, 2026.

BACKGROUND:

 

Two agreements to settle pending litigation, as defined in Government Code section 54956.9, became final during the period May 1, 2026, through May 31, 2026.

 

Jack Francis Bruce v. Angel Garcia, et al., United States District Court, Northern District of California, Case No. 4:25-cv-01297-YGR 2:  On April 14, 2026, the Board of Supervisors approved a settlement in this medical negligence case.  The Board approved the settlement for $100,000 in closed session by a vote of 5-0.  The settlement agreement was fully executed on May 5, 2026.  The funding source is the County’s Risk Management Liability Internal Service Fund.

 

Vyacheslav Viner, et al. v. Contra Costa County, et al., Contra Costa County Superior Court, Case No. C21-00187:  On November 4, 2025, the Board of Supervisors approved a settlement in this medical negligence case.  The Board approved the settlement for $1,700,000 in closed session by a vote of 5-0.  The settlement agreement was fully executed on May 12, 2026.  The funding source up to $1,000,000 is the County’s Risk Management Medical Malpractice Internal Service Fund, with the remainder of the settlement paid by Public Risk Innovations Solutions and Management, which functions as the County’s excess insurance provider.

 

CONSEQUENCE OF NEGATIVE ACTION:

 

The report would not be accepted.
