RECOMMENDATIONS:

APPROVE and AUTHORIZE the Clerk-Recorder, or designee, to execute a contract amendment with NBS Government Finance Group to extend the term from May 31, 2025 to October 31, 2025 with no change to the payment limit, for continued consultation on cost recovery and billing.

 

FISCAL IMPACT:

This agreement’s payment limit of $14,000 will remain unchanged, and the costs associated with it are 100% General Fund.

 

BACKGROUND:

The Clerk-Recorder Department’s Elections Division conducts elections for jurisdictions within the County. The Department seeks advice on recovering costs for election functions and equipment, and how to distribute those costs among participating jurisdictions in a consolidated election.

NBS Government Finance Group will support the Department in examining charges associated with the November 2024 General Election, comparing election billing methods from other California counties' Elections offices, and advising on potential modifications to billing methods for future elections.

This agreement includes an indemnification clause that may limit reimbursement of expenses if the County chooses to use its own legal defense for any claim covered by the contractor's general liability policy.

 

CONSEQUENCE OF NEGATIVE ACTION:

The Department would be unable to complete the evaluation of its election billing methodology, resulting in potentially unrecovered costs in future elections.
