Report Title: First American Data Tree End User License Agreement

RECOMMENDATIONS:
APPROVE and AUTHORIZE the District Attorney, or designee, to execute an End User License Agreement with First American Data Tree LLC in an amount not to exceed $3,600 for the software research tool for investigations of Real Estate Fraud for the period December 1, 2024 through November 30, 2025.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $3,600 which is included in the FY24-25 Departmental Budget and will be fully funded by the department's general fund allocation.
BACKGROUND:
Real estate fraud has become an increasing concern in recent years, with perpetrators often targeting older adults. To combat this issue, the District Attorney's Office will leverage the DataTree online platform to access and research recorded documents related to real estate transactions, with information critical to investigating real estate fraud. This platform not only supports the real estate fraud investigations, but also assists other investigative units within the District Attorney's Office and municipal and county law enforcement agencies with complex real estate related investigations. As a powerful research tool, DataTree enables the efficient retrieval of documents nationwide, allowing searches by location, owner, encumbrances, and uniquely - by keyword. This expanded capability will significantly enhance the District Attorney's Office's ability to conduct thorough investigations, surpassing the limitations of current resources.
The First American Data Tree End User License Agreement includes limitation of liability and indemnification for the County to hold Data Tree harmless from any claims arising out of the performance under this agreement.
