RECOMMENDATIONS:
ADOPT Resolution accepting completion of warranty period for the Subdivision Agreement, and release of cash deposit for faithful performance, subdivision SD19-09527, for a project developed by Pulte Home Company, LLC, as recommended by the Public Works Director, Discovery Bay area. (District III)
FISCAL IMPACT:
100% Developer Fees.
BACKGROUND:
The road improvements have met the guaranteed performance standards for the warranty period following completion and acceptance of the improvements.
CONSEQUENCE OF NEGATIVE ACTION:
The developer will not receive a refund of the cash deposit, the Subdivision Agreement and performance/maintenance surety bond will not be exonerated, and the billing account will not be liquidated and closed.
