Report Title:                     APPROVE AND AUTHORIZE termination of Tiedown Permit with Vicky Von Waldegg

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Director of Airports to terminate the Tiedown Permit with Vicky Von Waldegg. AUTHORIZE County Counsel to pursue legal action.

 

FISCAL IMPACT:

There is no negative impact on the General Fund. The Airport Enterprise Fund will cover the cost of any legal action. (100% Airport Enterprise Fund)

 

BACKGROUND:

On January 25, 2010, the County entered into a Tiedown Permit with Mr. Von Waldegg and Mrs. Von Waldegg to park their aircraft at Buchanan Field. Mrs. Von Waldegg advised Airports Staff on October 14, 2024, that Mr. Von Waldegg had passed away. As co-tenant on the agreement, Mrs. Von Waldegg continued as tenant of record. Because of her ongoing failure to pay rent, Mrs. Von Waldegg is currently in default under the Permit.

 

On January 29, 2026, a 4th Notice of Delinquency was mailed to the tenant by regular and Certified Mail, with a third copy sent by email.  The letter informed Mrs. Von Waldegg that to avoid termination of the Agreement, payment in full of all past due rents be delivered to the County by February 6, 2026. 

 

Airports staff is requesting authority to terminate the Permit and to pursue legal action against Mrs. Von Waldegg through County Counsel. Such actions are consistent with adopted Airport policies. 

 

CONSEQUENCE OF NEGATIVE ACTION:

Failure to terminate the Agreement and pursue legal action against Tenant would result in the Airport being unable to enforce adopted Airport policies and procedures.
