RECOMMENDATIONS:

APPROVE Fiscal Year 2024-25 Budget Amendment No. BDA-25-00119, authorizing the appropriation of fund balance in the amount of $49,876 to the District Attorney’s Consumer Protection Special Fund (0247) for additional services and expenditures provided.

 

FISCAL IMPACT:

The FY24-25 Adopted Budget includes $678,055 in obligated fund balance for the District Attorney’s Consumer Protection Special Fund (0247). This amendment will reduce that amount by $49,876 and increase appropriations in the Consumer Protection Special Fund by $49,876 to cover additional salary and operational expenses in FY24-25.

 

BACKGROUND:

Revenue of miscellaneous forfeits, penalties, judgement payments is allocated to the DA’s Consumer Protection Special Fund (Dept 0247) and is used to fund salary and benefits of DA employees working to investigate and prosecute cases in violation of consumer protection laws. In prior years, the DA has received higher amounts of forfeits, penalties, and judgement payments than the amounts needed for salary and operational expenses, which has resulted in Dept 0247 carrying a fund balance. In support of spending down the growing fund balance for increased operational expenditure needs in FY24-25, the DA’s Office is requesting approval to cover increased salary and operational costs in investigating and prosecuting cases in violation of consumer protection laws with Dept 0247 fund balance.

 

CONSEQUENCE OF NEGATIVE ACTION:

If unapproved, necessary appropriations would not be allocated to cover the expenditures for FY24-25.
