RECOMMENDATIONS:
Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (Flood Control District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute an amendment to the Memorandum of Understanding (MOU) agreement with John Muir Land Trust (JMLT) for the Pacheco Marsh / Lower Walnut Creek Restoration and Public Access Project (Project), Martinez area.

FISCAL IMPACT:
The amendment to the MOU agreement provides up to $900,000 in additional pass-through funds from San Francisco Bay Restoration Authority (Authority) Measure AA fund to JMLT to complete public access improvements for the Project. Funding will pass through Flood Control Zone 3B (252000). (Project No. 7520-6B8285)

BACKGROUND:
On December 14, 2020, the Flood Control District entered into a grant agreement with the Authority for funding the Project. This agreement also provided pass-through funds to JMLT for construction of public access improvements in the Project area. On December 9, 2020, the Flood Control District and JMLT entered into an MOU agreement, which identified the roles and responsibilities of each party for the Project. JMLT has requested additional funding to complete its public access improvements. The Flood Control District has unspent funds from the Authority allocation for the Project, mainly due to cost savings, and up to $900,000 is available to be allocated to JMLT for its public access improvements. The proposed amendment to the MOU agreement is needed to reflect this funding increase to JMLT.
