RECOMMENDATIONS:
APPROVE and AUTHORIZE the District Attorney, or designee, to execute a Terms of Sale - Resale Agreement with the ELD Experts LLC, dba Monarch in an amount not to exceed $3,489 to purchase and install a camera at the public service counter at the County Clerk-Recorder’s Office for investigative purpose.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $3,489 and will be funded by the Department’s Real Estate Fraud Prevention Special Fund. There is no General Fund impact.
BACKGROUND:
The District Attorney’s Office will purchase a camera from ELD Experts LLC, dba Monarch to be installed at the public service counter at the County Clerk-Recorder’s Office. The purchase and installation of the camera is for investigative purpose with the goal to have an investigative tool to capture potential fraudulent transactions at the Clerk-Recorder’s office.
Approval of the Terms of Sale - Resale Agreement will allow the District Attorney’s Office to use this tool for investigative purpose. This Terms of Sale - Resale Agreement includes Limitations of Liability and indemnification to hold Monarch harmless from any claims arising out of the performance under this agreement.
CONSEQUENCE OF NEGATIVE ACTION:
Without executing the Terms of Sale - Resale Agreement with ELD Experts LLC, dba Monarch, the District Attorney’s Office cannot utilize the tool needed to capture potential fraudulent transactions at the recorder’s office for investigative purpose.
