RECOMMENDATIONS:
APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute an Exclusive Negotiating Agreement with EmpowHER Builders, LLC, a California Limited Liability Company, for the development of 42 to 70, 100% affordable multi-family residences at 190 Bel Air Lane in Bay Point (APN 093-170-056) with a six-month term and up to three six-month renewal periods.
FISCAL IMPACT:
There is no negative impact on the General Fund. If the option is exercised, proceeds from the sale will be deposited into the Housing Successor Fund.
BACKGROUND:
Contra Costa County, in its capacity as housing successor to the Contra Costa County Redevelopment Agency (County) pursuant to Health and Safety Code Section 34176, owns certain real property located at 190 Bel Air Lane in Bay Point. The subject site is undeveloped, totaling 24,481 square feet in gross area, and was acquired by the Contra Costa County Redevelopment Agency on December 15, 1993. The site is on the Housing Asset Transfer list developed by the County and approved by the Department of Finance following the dissolution of Redevelopment.
The County issued a Notice of Surplus Lands Availability on November 14, 2023. On February 12, 2024, a letter from EmpowHER Builders, LLC was received inquiring about purchasing the site for the purpose of developing affordable housing.
Following execution of the Exclusive Negotiation Agreement, the parties will negotiate all terms and conditions of a Disposition and Development Agreement (DDA) pursuant to the Exclusive Negotiation Agreement. The DDA will be subject to approval by the Board of Supervisors.
CONSEQUENCE OF NEGATIVE ACTION:
Development of a Housing Successor asset will be delayed.
