Report Title:                     APPROVE AND AUTHORIZE termination of Tiedown Permit with Ben J. Pfaff.

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Director of Airports to terminate the Tiedown Permit with Ben J. Pfaff. AUTHORIZE County Counsel to pursue legal action if necessary.

 

FISCAL IMPACT:

The Airport Enterprise Fund will cover the cost of any legal action.

 

BACKGROUND:

On September 27, 2022, the County entered into a Tiedown Permit (Permit) with Ben J. Pfaff (Tenant) to park his aircraft at Buchanan Field. Due to Mr. Pfaff’s ongoing failure to pay rent, Airports management is recommending termination of the Permit.

 

Airports staff have made numerous attempts to contact Mr. Pfaff about his outstanding balance; however, no payments have been made in months. On May 15, 2026, a Final Notice of Delinquency was mailed to the tenant by Certified Mail, with a copy sent by email.  The letter informed Tenant that to avoid termination of the Agreement, all outstanding balances must be delivered to the County by May 22, 2026. 

 

Airports staff is requesting authority to terminate the Permit pursuant to Section 9 (Termination by County for cause) of the Permit, and if necessary, pursue legal action against Tenant through County Counsel. Such actions are consistent with adopted Airport policies. 

 

CONSEQUENCE OF NEGATIVE ACTION:

Failure to terminate the Agreement and pursue legal action against Tenant would result in the Airport being unable to enforce adopted Airport policies and procedures.
