RECOMMENDATIONS:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute contract Amendment No. 3 with Empower Programs Inc., to increase the payment limit by $117,540 from $315,000 to a new payment limit of $432,540 to provide on-call weed abatement services, and to extend the term from March 31, 2024, to March 31, 2025, Alamo, Concord, Danville, Pleasant Hill, San Ramon, and Walnut Creek areas. (Districts II and IV)

FISCAL IMPACT:
100% Iron Horse Corridor Trust Funds.

BACKGROUND:
The County Public Works Department has overall management responsibility of the Iron Horse Corridor (IHC) and performs the majority of its maintenance. The IHC, formerly known as the Southern Pacific Railroad right of way, is 18.5 miles long, traversing north-south in Central Contra Costa County. The northern terminus is at Mayette Avenue in Concord and the southern terminus is at the Alameda County line in San Ramon. The corridor varies in width from 30 to 100 feet and currently has a 10-foot wide, paved multi-use trail located within the pathway that is managed by East Bay Regional Park District (EBRPD).
On April 23, 2020, the Board of Supervisors approved a contract with Empower Programs Inc., to provide weed abatement services. With this amendment, the contractor shall continue to provide weed abatement services in the IHC in South and Central Contra Costa County in accordance with the Contra Costa County Fire Protection District Weed Abatement Standards. These services will assist the County in meeting the Fire District's deadline for completion of mowing along the IHC.
