RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent or designee to execute, on behalf of the District Attorney, a nonfinancial agreement and related terms of use with Waste Management Property Holdings, LLC for the transportation, temporarily holding and removal of waste for the District Attorney’s Office to conduct inspections for investigative purposes.
FISCAL IMPACT:
No fiscal impact. This is a nonfinancial agreement.
BACKGROUND:
The District Attorney’s Office will partner with Waste Management Property Holdings, LLC. for the transportation and temporarily storage of trash so that DA Senior Inspectors can perform inspections following safety protocols. The District Attorney’s Office can request removal of the waste by issuing written notices to Waste Management.
Approval of this nonfinancial agreement will enable the District Attorney’s Office to perform investigations of waste and have a temporary storage area for the waste. This agreement includes limited liability and indemnification under which the County agrees to hold Waste Management Property Holdings, LLC. harmless from any claims related to the transportation, temporarily holding and removal of waste. Although there is no term limit associated with this agreement, the County may seek to renew in three years.
CONSEQUENCE OF NEGATIVE ACTION:
Without executing the nonfinancial agreement and the related terms of use with Waste Management Property Holdings, LLC., the District Attorney’s Office cannot transport, temporarily store and remove waste for investigation purposes.
