Report Title:                     Agreement with Indivior Inc. including Limited Liability provisions

Recommendation of the County Administrator Recommendation of Board Committee

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute, on behalf of the Health Services Department, a pharmaceutical pricing agreement with Indivior Inc., the manufacturer of Sublocade, effective the date of the last Party’s signature and continue for one (1) year terms until terminated.

FISCAL IMPACT:

Approval of this agreement will result in pharmaceutical discounts for the purchase of Sublocade that is funded by the Opioid Settlement Funds.

BACKGROUND:

On March 26, 2024 the Board of Supervisors approved item C.34 to execute purchase order #30107 with Priority Healthcare Distribution Inc. (dba Curascript Specialty Distribution), the distributor of Sublocade in the amount of $240,000 for the period of March 1, 2024 through February 28, 2025 using the Opioid Settlement Funds for the Martinez Detention Facility. This pricing agreement will allow the Martinez Detention Center to purchase Sublocade at a 19% discount.

Due to the terms and conditions including limited liability provisions, we are requesting Board of Supervisor approval.

CONSEQUENCE OF NEGATIVE ACTION:

If this action is not approved, the Martinez Detention Center will not be eligible for the Sublocade discount.
