RECOMMENDATIONS:
ADOPT Resolution accepting completion of the warranty period for the Subdivision Agreement, release of cash deposit for faithful performance, and declaring multiple roads as County Roads, subdivision SD05-09037, for a project developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, Danville area. (District II)
FISCAL IMPACT:
100% Developer Fees.
BACKGROUND:
The road improvements have met the guaranteed performance standards for the warranty period following completion and acceptance of the improvements. The warranty period was extended and developer ownership was maintained at the developer’s request to maintain access control while homes were constructed.
The emergency vehicle access (EVA) between Robert Duchi Way and Connemara Court is not being accepted as a County Road as it was only dedicated for emergency access.
CONSEQUENCE OF NEGATIVE ACTION:
The developer will not receive a refund of the cash deposit, the Subdivision Agreement and performance/maintenance surety bond will not be exonerated.
