Report Title:                     Encroachment Agreement with City of Concord for Stream Gauge Monitoring

RECOMMENDATIONS:

Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute an Encroachment Agreement with City of Concord (City) that allows the District to install and maintain a stream gauge and other monitoring equipment within the City’s jurisdiction on the Marsh Drive Bridge, effective May 14, 2024, which agreement will remain in effect until terminated in writing by either party. (District IV) (Project No.: 7505-6F8156)

 

FISCAL IMPACT:

No fiscal impact.  No payments will be made to the City of Concord.

 

 

BACKGROUND:

The District monitors the collection of rain and stream gauges and precipitation recorder data, which also includes maintenance of rain and stream gauges throughout Contra Costa County. The district desires to install a stream gauge and related equipment on the east portion of the Marsh Drive Bridge, located in jurisdiction of the City of Concord. The City requires an Encroachment Agreement.  As part of the Agreement, the District will indemnify and defend the City from any liabilities that arise from the use of the City’s property. District staff recommend that the Board approve the execution of the Encroachment Agreement to ensure the District can collect important rain and weather-related information.

 

 

CONSEQUENCE OF NEGATIVE ACTION:

If the Encroachment Agreement is not approved, the District will not be able to install and monitor the stream gauge equipment for data collecting.
