Report Title: Execute an Encroachment Stipulation Letter and a Damage Prevention Reimbursement Agreement with Santa Fe Pacific Pipeline, LP.
Recommendation: Recommendation of the County Administrator
RECOMMENDATIONS:
Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (FCD), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute an Encroachment Stipulation Letter and a Damage Prevention Reimbursement Agreement with Santa Fe Pacific Pipeline, LP (SFPP), to allow work by the FCD and their contractor within SFPP easements as part of the Wildcat Creek Fish Passage Implementation Project, North Richmond.
FISCAL IMPACT:
The Damage Prevention Reimbursement Agreement with SFPP requires an inspection deposit of $15,000 for review and inspection services, with final costs based upon the actual cost of services rendered, to be paid by 100% Flood Control District Funds. Project No. 7505-6F8101
BACKGROUND:
In February 2026, SFPP was notified of the Wildcat Creek Fish Passage Implementation Project, North Richmond. This project will replace a defunct fish passage system with a new one. The project started construction on June 15, 2026. SFPP has critical underground hydrocarbon product lines crossing the project site that are near construction activities. During recent discussions, the FCD was notified of SFPP’s requirements to enter into an Encroachment Stipulation Letter and Damage Prevention Reimbursement Agreement in order to continue working in the proximity of their critical facilities.
CONSEQUENCE OF NEGATIVE ACTION:
Without the Board of Supervisors’ approval, the FCD will not be able to complete construction work near the SFPP facilities, which would delay the construction work until next summer, at additional expense.
