RECOMMENDATIONS:

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Change Order No. 1 with Mark Scott Construction, Inc., for Job Order Contract 024 to increase the payment limit by $2,900,000 to a new payment limit of $5,400,000, as allowed by Public Contract Code 20128.5 (W4011C), Countywide. 

 

FISCAL IMPACT:

100% Various Funds.  Projects under Mark Scott Construction, Inc.’s Job Order Contract (JOC) 024 are only issued when there is an approved project and funding.

 

BACKGROUND:

On April 4, 2023, job order construction contracts were awarded to the four lowest and responsive bidders, namely, Aztec Consultants (JOC 021), MVP Construction (JOC 022), A CST Group, Inc. d/b/a Dynasel USA (JOC 023) and Mark Scott Construction (JOC 024) for job orders under the Job Order Contracts in amounts to total not less than $25,000 nor more than $2,500,000.  The payment limit for Mark Scott Construction, Inc. needs to be increased because we have several forecasted repair and remodeling projects down the pipeline and Mark Scott Construction, Inc.’s contract payment limit will soon be depleted; therefore, the Public Works Director recommends that the Board approve Change Order No. 1 with Mark Scott Construction, Inc., to increase the payment limit under their Job Order Contract from $2,500,000 to a new payment limit of $5,400,000, as allowed by Public Contract Code 20128.

 

CONSEQUENCE OF NEGATIVE ACTION:

If the Change Order is not approved, the County will be limited in its ability to select the best suited Job Order Contract contractor for appropriate County construction projects involving repair, remodeling, and other repetitive work.
