RECOMMENDATIONS:
APPROVE and AUTHORIZE the Director of Airports to terminate the T-Hangar and Shade Hangar Rental Agreement with Grace Gatpandan. AUTHORIZE County Counsel to pursue legal action if necessary, Concord area.
FISCAL IMPACT:
There is no negative impact on the General Fund. The Airport Enterprise Fund will cover the cost of any legal action.
BACKGROUND:
On April 5, 2024, the County entered into a T-Hangar and Shade Hangar Rental Agreement with Grace Gatpandan to store her aircraft at Buchanan Field. Ms. Gatpandan has received three notices for delinquent rent over the last four months and has been delinquent 16 times over the past 24 months. Due to Ms. Gatpandan’s ongoing failure to pay rent, Airports management is recommending termination of the Agreement.
Airports staff is requesting authority to terminate the Agreement pursuant to Section 6 (Term) of the Agreement, and if necessary, pursue legal action against Tenant through County Counsel. Such actions are consistent with adopted Airport policies.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to terminate the Agreement and pursue legal action against Tenant would result in the Airport being unable to enforce adopted Airport policies and procedures.
