Report Title: APPROVE and AUTHORIZE Amendment No. 1 to Consulting Services Agreement with Swinerton Builders

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with Swinerton Builders, effective May 21, 2024, to increase the payment limit by $1,000,000 to a new payment limit of $2,000,000 and to extend the term from December 31, 2025 through December 31, 2026 to provide on-call project management services for various County projects.
FISCAL IMPACT:
100% various funds as projects are awarded.
BACKGROUND:
On December 13, 2022, the Board of Supervisors approved an on-call project management services contract with Swinerton, in the amount of $1,000,000.
Since then, nearly all of the available fee under the Agreement has been committed to services associated with the County's Central County Storage Facility project. In the meantime, the number of projects with upcoming construction budgets exceeding $1,000,000 handled by Capital Projects Management Division of Public Works has ballooned. Over the course of the past 18 months, the number of such projects has increased from 16 to 26 (with another 9 on our radar).
The Central County Storage Facility project is in the early stages of design. As the project moves forward, unexpected developments could result in a need for additional project management services. Therefore, it is advisable to have fee capacity in reserve under the Swinerton on-call Consultant Services Agreement to address such events. Furthermore, the Central County Storage Facility project is expected to be completed no earlier than sometime in 2026, whereas the Swinerton Agreement expires on December 31, 2025.
