RECOMMENDATIONS:
RATIFY the Health Services Director's designee, Irene Lo, MD, FACS, April 2, 2026, execution of a Data Protection Agreement with MedImpact Healthcare Systems, Inc., a corporation, to allow parties to securely exchange necessary data concerning operation as the delegated Pharmacy Benefit Manager (PBM) and prescription pharmacy administrator for the Contra Costa Health Plan (CCHP) Commercial and Medicare Advantage Dual Eligible Special Needs (DSNP) members prescription benefit, effective upon final signature until terminated by either party.

FISCAL IMPACT:
This is a non-financial agreement. There is no cost to the County.

BACKGROUND:
CCHP currently delegates its prescription pharmacy benefit administration to PerformRx who will cease operations in California as of December 31, 2026. CCHP as a healthplan offers prescription drug benefit coverage for its members enrolled in the County's CCHP Commercial Plan A and Plan B medical benefit plans as well as its Medicare Advantage DSNP benefit plan. To fulfill its regulatory obligations as promulgated by the Department of Managed Health Care (DMHC), and the Centers for Medicare and Medicaid Services (CMS), CCHP has identified Contractor as an alternative PBM for calendar year 2027. Contractor understands the California marketplace given its market experience in working with other Managed Medi-Cal healthplans. CCHP believes MedImpact will be operationally ready to assume the CCHP's prescription pharmacy benefit later in 2026 after the parties successfully complete negotiations of a PBM Agreement. This Data Protection Agreement is a required preliminary step in the process prior to the parties finalizing the terms of a PBM Agreement.
