Report Title:                     Amendment to the Memorandum of Understanding Agreement with John Muir Land Trust for Pacheco Marsh / Lower Walnut Creek Restoration and Public Access Project.

RECOMMENDATIONS:

Acting as the governing body of the Contra Costa County Flood Control and Water Conservation District (Flood Control District), APPROVE and AUTHORIZE the Chief Engineer, or designee, to execute an amendment to the Memorandum of Understanding agreement (MOU) with John Muir Land Trust (JMLT) for the Pacheco Marsh / Lower Walnut Creek Restoration and Public Access Project (Project), Martinez area.

 

FISCAL IMPACT:

The amendment to the MOU provides an additional $3,000,000 in pass-through funds from San Francisco Bay Restoration Authority (Authority) for JMLT to complete public access improvements for the Project. Funding will pass through Flood Control Zone 3B (252000). (Project No. 7520-6B8285)

 

BACKGROUND:

On December 14, 2020, the Flood Control District entered into a grant agreement with the Authority for funding the Flood Control District's Project. This agreement also provided pass-through funds to JMLT for construction of public access improvements in the Project area.  On December 9, 2020, the Flood Control District and JMLT entered into an MOU agreement, which identified the roles and responsibilities of each party for the Project.  On July 9, 2024, the Board of Supervisors approved an amendment to the grant agreement between the Authority and the Flood Control District increasing the pass-through funds to JMLT from $1 million to $4 million.  The proposed amendment to the MOU is needed to reflect this funding increase.

 

CONSEQUENCE OF NEGATIVE ACTION:

Without Board approval, public access portions of the Project will not be implemented.
