Report Title: Purchase Order and Related Software License Agreement with First American Data Tree, LLC

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent or designee to execute, on behalf of the District Attorney, a purchase order and related license agreement with First American Data Tree, LLC in an amount not to exceed $3,600 for accessing a software research tool for real estate fraud investigations, for the period December 1, 2025 through November 30, 2026.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $3,600 which is included in the FY25-26 Departmental Budget.
BACKGROUND:
The District Attorney’s Office uses First American Data Tree, LLC to access and research recorded documents related to real estate transactions, with information critical to real estate fraud investigations. As a powerful research tool, First American Data Tree enables efficient, nationwide retrieval of documents, allowing searches by location, owner, encumbrances, and uniquely - by keywords. This expanded capability significantly enhances the District Attorney’s Office ability to conduct thorough investigations.
This Software License Agreement includes a limitation of liability and indemnification clause, under which the County agrees to hold First American Data Tree, LLC harmless from any claims arising out of the performance under this agreement.
CONSEQUENCE OF NEGATIVE ACTION:
Without executing the Purchase Order and related Software License Agreement with First American Data Tree, LLC, the District Attorney’s Office will be unable to utilize a powerful research tool essential for real estate fraud investigations.
