Report Title: Berla Terms and Conditions Agreement

RECOMMENDATIONS:
APPROVE and AUTHORIZE the District Attorney, or designee, to execute a Terms and Conditions Agreement with Berla Corporation in an amount not to exceed $9,750 for the usage of a vehicle infotainment forensics software for the period December 1, 2024 through November 30, 2027.
FISCAL IMPACT:
Approval of this action will result in expenditures of up to $9,750 and is included in the FY24-25 Departmental Budget.
BACKGROUND:
Berla Corporation, the manufacturer of the iVe software, is the industry leader in conducting vehicle infotainment forensics. This area of forensics involves the extraction and analysis of data generated and stored by a vehicle. In many cases, data from the occupants' cellular phones can be captured when they connect their phone to the vehicle. The data retrieved by Berla's iVe software includes identifiers for the cellular phones, such as call logs and text messages, as well as vehicle location history, speed, braking, and other useful information.
The District Attorney's Office's use of Berla iVe will be instrumental in collecting evidence for sexual assault cases, robberies, and homicides. Berla's technology to access information from connected devices to vehicles allows the District Attorney's Office to solve more cases. The District Attorney's Office is one of the few agencies in the county with trained personnel, tools, and experience to leverage this investigative resource.
The Berla Terms and Conditions Agreement includes limitation of liability and indemnification for the County to hold Berla Corporation harmless from any claims arising out of the performance under this agreement.
