RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, a purchase order with Airgas USA, LLC in an amount not to exceed $50,000 and Product Sale Agreement for the rental of oxygen cylinders for Public Health Clinic Services for the period from October 1, 2025 through September 30, 2030.

 

FISCAL IMPACT:

Approval of this action will result in expenditures of up to $50,000 over a five-year period and will be funded by Hospital Enterprise Fund I revenues.

 

BACKGROUND:

Airgas USA, LLC will provide monthly rental of oxygen cylinders (oxygen tanks) to the Public Health Clinic Services (PHCS) team for use at various clinic and mobile clinic locations throughout the county. PHCS will exchange empty tanks for full ones as needed to ensure continuous availability. This purchase is being justified via sole source.

 

The Product Sale Agreement obligates the County to indemnify, defend and hold harmless Airgas USA, LLC from and against any and all claims including but not limited to reasonable attorney fees. Airgas USA, LLC and their suppliers’ liability under this agreement is limited to the refund of the purchase price or replacement of the product or service in question.

 

CONSEQUENCE OF NEGATIVE ACTION:

Supporting the mobile units and clinic sites for Public Health Clinic Services (PHCS) is crucial. Oxygen tanks must be available for immediate use in each patient care unit or service area due to potential medical emergencies. Failure to approve this action could result in insufficient oxygen supply, putting patient safety at risk.
