Report Title: Resolution of Acceptant and Notice of Completion for Generator Project, 1960 and 1980 Muir Road, Martinez (WH348C)

RECOMMENDATIONS:
Adopt Resolution accepting as complete the contracted work performed by Aztec Consultants, a California Corporation, for the Generator Project, 1960 and 1980 Muir Road, Martinez.
FISCAL IMPACT:
No fiscal Impact associated with accepting completion of contracted work.
BACKGROUND:
On March 22, 2022, the Board awarded a contract to the lowest responsive and responsible bid submitted in the amount of $875,000 to Aztec Constructors to replace two (2) aging outdoor generators and associated two (2) automatic transfer switches with in-kind units. The existing chain link fence enclosure was also to be replaced and existing concrete pad extended at 1960 and 1980 Muir Road, Martinez.
After the contract was awarded to Aztec Constructors, the Sheriff's Department could not procure additional funds to supplement the budget's overage. A deductive change order was created to remove a portion of the original scope of work. This entailed removing the work covering the largest generators serving 1960 Muir Road along with work to remove the replacement of the existing chain link fence enclosure as well as the concrete pad extension. The deductive change reduced the budget from $875,000 to $472,00 and the work entailing the replacement of the oldest generator and transfer switches at 1980 Muir Road was continued.
CONSEQUENCE OF NEGATIVE ACTION:
Accepting the contract as complete is standard procedure and allows for proper closeout of the contract. If the contract is not accepted as complete, the period for filing stop payment notices bond claims may be extended and then Contra Costa County will incur expenses for additional contract administration.
