RECOMMENDATIONS:
APPROVE and AUTHORIZE the Purchasing Agent, or designee, to execute on behalf of the Health Services Director, a purchase order with American Messaging Services, LLC in an amount not to exceed $15,000 and a related Customer Agreement for pager services during the period of July 1, 2024 through June 30, 2027.

FISCAL IMPACT:
Approval of this action will result in expenditures of up to $15,000 over a three-year period and will be funded by the Certified Unified Program Agency fees. There is no impact to the County General Fund.

BACKGROUND:
Hazmat has utilized American Messaging for our incident response operations. The technology works in conjunction with the Community warning system to notify hazardous material staff of incidents. We have used this vendor since 2013 following the original vendor acquisition of Cook paging.

The related Customer Agreement requires the County to indemnify American Messaging Services, LLC (AMS) from any claims, liabilities, damages, and expenses arising out of or in any manner connected with the quality and condition of the paging services procured under this agreement. Under the agreement, AMS will not be liable to County for any loss, damage, or expense of any kind caused directly or indirectly by the equipment, or by any interruption of the services. AMS will also not be liable for any breach of warranty by: County's or End User's misuse of the services or use of services beyond the scope permitted by agreement; use of services with software or hardware incompatible with the services; reduced performance or non-availability of services as a result of network or telecommunications connections issues; or breach of obligations or warranties under the agreement.
