Report Title:                     Purchase Order and Related Software License Agreement with Magnet Forensics, LLC.

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent to execute, on behalf of the District Attorney, a purchase order and related license agreement with Magnet Forensics, LLC in an amount not to exceed $21,475 for data extraction forensic software licenses used in criminal investigations for the period January 1, 2026 through December 13, 2026.

 

FISCAL IMPACT:

Approval of this action will result in expenditures up to $21,475 which have been included in the Department’s FY25-26 Budget.

 

BACKGROUND:

The District Attorney’s Office uses the Magnet Forensics system as a forensic tool to extract data from suspects’ cell phones to be used in criminal investigations and prosecutions. The Magnet Forensics system can extract data from unlocked and locked phones and handsets. The system filters important data that the DA’s Investigation teams need to review, reducing the overall time to locate, recover and collect evidence.

 

Approval of the purchase order and related Software License Agreement will allow the District Attorney’s Office to continue using this tool to support these critical investigative and trial preparation functions. This Software License Agreement includes a limitation of liability and indemnification under which the County agrees to hold Magnet Forensics, LLC harmless from any claims arising out of the performance under this agreement.

 

CONSEQUENCE OF NEGATIVE ACTION:

Without executing the Purchase Order and related Software License Agreement with Magnet Forensics, LLC, the District Attorney’s Office cannot continue to utilize the forensic tool needed for criminal investigative and prosecution purposes.
