Report Title: ADOPT Ordinance No. 2025-18 to establish a 13% reduction of the applicable County Area of Benefit traffic impact mitigation fee for housing developments located in transit priority areas and meeting all other criteria in Government Code section 66005.1(a).

RECOMMENDATIONS:
ADOPT Ordinance No. 2025-18 to establish a 13% reduction of the applicable County Area of Benefit traffic impact mitigation fee for housing developments located in transit priority areas and meeting all other criteria in Government Code section 66005.1(a), Countywide.
DETERMINE that this activity is exempt from review under the California Environmental Quality Act (CEQA), pursuant to CEQA Guidelines section 15061(b)(3), because it can be seen with certainty that there is no possibility that this activity may have a significant effect on the environment.
AUTHORIZE the Public Works Director, or designee, to cause a CEQA Notice of Exemption to be filed with the County Clerk and State Clearinghouse, and to pay the $50.00 filing fee.
FISCAL IMPACT:
Adoption of Ordinance No. 2025-18 will result in a 13% reduction of Area of Benefit transportation mitigation fees from new residential developments that meet the specific requirements of Government Code section 66005.1(a). These reductions are required by state law. Funding shortfalls in Area of Benefit fee programs caused by this reduction will need to be made up using funds from other sources, such as gas tax, Measure J funds, and other state and federal funds.
