Report Title:                     West County Wastewater District Release of Liability Agreement for the West County Reentry, Treatment and Housing Project

RECOMMENDATION:

APPROVE and AUTHORIZE the County Administrator, or designee, to sign a Release of Liability Agreement with the West County Wastewater District for a new sewer connection for the West County Reentry, Treatment and Housing project at 5555 Giant Highway, Richmond, CA.

 

FISCAL IMPACT:

No fiscal impact. 

 

BACKGROUND:

As part of the West County Reentry, Treatment and Housing (WRTH) project the County has to design a new wastewater connection to the main West County Wastewater District (WCWWD) system.  WCWWD is concerned about the overall capacity of their system to handle the additional connection and had concerns about the engineering design of the County’s proposed system and connection.  The County and WCWWD have agreed that a release of liability agreement would resolve the concerns about the proposed system and connection.  The County will agree to release WCWWD from liability if the system and/or connection to their force main fails because of the County’s proposed system sizing and design.

 

Consequences of Negative Action:

Not taking this action would delay the approval of the wastewater system and connection and increase the costs of the WRTH project by requiring a new system design at a higher cost.
