Report Title:                     APPROVE the FCZ 1 Marsh Creek Storm Damage Repair Project and take related actions under CEQA

Recommendation of the County Administrator Recommendation of Board Committee

 

RECOMMENDATIONS:

APPROVE the FCZ 1 Marsh Creek Storm Damage Repair Project (Project) and AUTHORIZE the Chief Engineer, or designee, to advertise the Project, Brentwood area.  [County Project No. 0672-6D9M03, DCD CP#25-12] (District III).

 

DETERMINE that this activity is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines 15301(d).

 

DIRECT the Director of Department of Conservation and Development (DCD), or designee, to cause a CEQA Notice of Exemption (NOE) to be filed with the County Clerk and State Clearinghouse, and

 

AUTHORIZE the Public Works Director, or designee, to arrange for payment of a $50 fee to the County Clerk for filing the NOE.

 

FISCAL IMPACT:

Estimated Project cost: $1,211,000.00 (100% Flood Control Zone 1 Funds)

 

BACKGROUND:

The purpose of the project is to repair erosion at three sites along the west bank of Marsh Creek between Delta Road and Sunset Road in the Brentwood area that were damaged during the 2023 winter storm events. At each site, the repair will consist of removing the eroded bank material and backfilling with soil-filled rock slope protection.

 

The project is exempt from CEQA because it consists of repairing damaged portions of an existing flood control facility to meet current standards of public health and safety involving no expansion of existing use pursuant to Section 15301 of the CEQA Guidelines.

 

CONSEQUENCE OF NEGATIVE ACTION:

Delay in approving the project may result in a delay of design, construction, and may jeopardize funding. Erosion will worsen at the project sites, which might damage nearby properties.
