Report Title: Approve and Authorize Termination of Hangar Agreement with Devin Adami

RECOMMENDATIONS:
APPROVE and AUTHORIZE the Director of Airports to terminate the Hangar Rental Agreement with Devin Adami. AUTHORIZE County Counsel to pursue legal action if necessary, Pacheco area.
FISCAL IMPACT:
The Airport Enterprise Fund will cover the cost of any legal action.
BACKGROUND:
In March of 2013, the County entered into a Hangar Rental Agreement (Agreement) with Devin Adami (Tenant) to store his aircraft at Buchanan Field Airport (Airport). For more than five years, Mr. Adami’s aircraft has not been stored at Buchanan Field, but instead at the Truckee-Tahoe airport. Furthermore, based on conversations with Airports Management, Mr. Adami does not have plans for his aircraft to use the Airport. The Airport has a waiting list populated by prospective tenants that will utilize the hangar to store an aircraft and contribute to the Airport’s economic engine. To that end, Airports management is recommending termination of the Agreement, that will then allow the hangar to be rented and utilized by someone else.
Airports staff is requesting authority to terminate the Agreement pursuant to Section 6 (Term) of the Agreement to provide 30-days’ notice of termination, and if necessary, pursue legal action against Tenant through County Counsel. Such actions are consistent with adopted Airport policies.
CONSEQUENCE OF NEGATIVE ACTION:
Failure to terminate the Agreement and pursue legal action against Tenant would result in the Airport being unable to enforce adopted Airport policies and procedures.
