Recommendation of the County Administrator Recommendation of Board Committee

RECOMMENDATIONS:

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a license with Judicial Council of California, effective January 1, 2023, for approximately 80 square feet of office space located at 1010 Ward Street, Room 19, in Martinez, that will continue until terminated, with an initial annual rent of $2,160, and annual increases, thereafter, as requested by the Public Defender.

FISCAL IMPACT:

AB109 - Public Safety Realignment.  (100% State)

BACKGROUND:

Public Defender (PD) has utilized a designated office in the Court Annex Brae Building for well over 10 years. The court team of attorneys and other staff rely very heavily on daily use of this office to prepare for court, to interview clients, to print documents onsite, and to ensure that they are able to serve their clients and the public in an efficient and confidential manner.  Recently, the Court requested that the PD enter into a license agreement and pay a license fee beginning January 1, 2023, for the use of this designated office.

CONSEQUENCE OF NEGATIVE ACTION:

The Public Defender’s service to their clients would be disrupted and the County would need to identify a different location for the use of the Public Defender.
